1. Who we are
EyeZenith is made by Auto Train Brain Inc., a Delaware corporation, at 320 Cobble Creek Curve, Suite 130, Newark, DE 19702, United States. You can reach us at info@autotrainbrain.com or +1 213 423 0846.
On the App Store, EyeZenith is sold by HMS Health Mobile Software A.Ş. On Google Play, it is distributed by Auto Train Brain Inc.
These terms are an agreement between you and Auto Train Brain Inc. (“we”, “us”). They cover the EyeZenith app, the EyeZenith pages on autotrainbrain.com, and any EyeZenith subscription you buy. By downloading or using EyeZenith, you agree to them. If you do not agree, do not use the app.
2. What EyeZenith is — and what it is not
EyeZenith is a wellness product. It takes four short readings from your phone’s camera, microphone and motion sensors, combines them into a single daily number, and suggests one thing you might do next.
EyeZenith is a wellness product. It is not a medical device, it has not been cleared or approved by the FDA, and it is not intended to diagnose, treat, cure or prevent any disease or medical condition. Readings are estimates from consumer phone sensors, not measurements from clinical instruments. Talk to a qualified professional about any health question or concern.
Do not use EyeZenith in an emergency. If you think you are having a medical emergency, call 911 or your local emergency number.
Do not use EyeZenith while driving, cycling, operating machinery, or doing anything else that needs your attention.
Nothing EyeZenith shows you is medical advice, and nothing in the app should replace a conversation with a doctor, nurse, pharmacist, therapist or other qualified professional. Decisions about your health are yours to make, ideally with someone qualified to help you make them.
3. Who may use EyeZenith
You must be at least 18 years old to buy an EyeZenith subscription.
People aged 13 to 17 may use the free app with a parent or guardian’s permission and supervision. The parent or guardian is responsible for that use and for any subscription bought on the young person’s behalf.
EyeZenith is not for children under 13. We do not knowingly collect information from anyone under 13. If you believe a child under 13 has used the app, write to privacy@autotrainbrain.com and we will delete what we have.
4. Your phone and your readings
EyeZenith needs access to your camera, microphone and motion sensors to take a reading. Your phone will ask you for each permission, and you can withdraw any of them at any time in your phone’s settings. Without them, the corresponding reading will not work.
Camera frames and audio are processed on your device. What we do and do not send anywhere is set out in the Privacy Policy, which forms part of these terms. Where the Privacy Policy and these terms describe the same thing differently, the Privacy Policy governs.
A reading depends on your phone’s hardware, your lighting, your grip and your surroundings. Two phones will not produce identical numbers, and the same phone will not produce identical numbers in different conditions. The number is a record you keep over time, not a measurement of a fixed quantity.
5. The free trial
EyeZenith is free to download and free to use for three days of Premium features.
We do not take a credit card to start the trial. The trial ends on its own after three days. Nothing is charged, and nothing renews automatically, unless you separately choose to subscribe afterwards. There is no step you need to take to avoid being charged at the end of a trial.

6. Subscription, price and renewal
EyeZenith Premium costs $9.99 per month in the United States. Prices in other countries are set by the store in local currency and may differ.
Payment is taken by the App Store or Google Play, not by us. We never see or store your card details.
If you subscribe, the subscription renews every month at $9.99 until you cancel. Your store charges you within 24 hours before each renewal.
If we change the price, you will be told in advance through the store, and the change will only apply to you if you accept it, in line with Apple’s and Google’s rules. We will not raise the price of a running subscription without your consent.
7. Cancelling
You can cancel at any time, from your App Store or Google Play account settings. Cancelling is a setting on your side; you do not need to contact us, and we cannot cancel a store subscription on your behalf.
Cancelling stops the next charge. It does not remove the app, and it does not delete readings you have already taken. Premium features stay available until the end of the period you have already paid for.

8. Refunds
Because Apple and Google take the payment, Apple and Google handle refunds, under their own published policies. We cannot process a refund for a store purchase, and we cannot promise one. If you want a refund, request it through the App Store or Google Play.
If you think you were charged in error, write to info@autotrainbrain.com and we will help you make the case to the store.
9. What you may and may not do
You may use EyeZenith for your own personal, non-commercial wellness. We grant you a personal, non-exclusive, non-transferable, revocable licence to do that.
You may not: sell, rent, sublicense or redistribute the app; copy, modify, reverse-engineer, decompile or try to extract the source code, except to the extent the law says you may; use the app to provide a service to other people; use it to make clinical, diagnostic, employment, insurance or fitness-for-duty decisions about anyone; scrape, probe or overload our systems; or use the app in a way that breaks the law.
10. Our material
EyeZenith, the EyeZenith name and logo, the app, its design and its content belong to Auto Train Brain Inc. or our licensors. These terms do not transfer any of that to you.
Your readings are yours.
11. The app stores
EyeZenith is distributed through the App Store and Google Play. Their own terms apply to your download and your payment alongside these terms.
Apple is not a party to these terms. Apple has no obligation to provide support for EyeZenith. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Changes to the app
We may add, change or remove features, and we may stop offering EyeZenith. If we withdraw a paid feature you are subscribed to, or stop the service entirely, we will tell you in advance and you can cancel.
13. No warranty
EyeZenith is provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the app will be uninterrupted, error-free, or that any reading is accurate.
Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of EyeZenith.
To the maximum extent permitted by law, our total liability to you for any claim relating to EyeZenith is limited to the amount you paid us for EyeZenith in the twelve months before the claim arose.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
Some jurisdictions do not allow these limits, so some of this may not apply to you.
15. Suspension and ending
We may suspend or end your access if you break these terms, or if we are required to by law. You may stop using EyeZenith at any time by deleting the app and, if you have one, cancelling your subscription in your store.
16. Changes to these terms
We may update these terms. When we do, we will change the “last updated” date at the top and post the new version at this address. If a change materially reduces your rights, we will give you notice in the app or by email before it takes effect. If you keep using EyeZenith after a change takes effect, you accept it.

17. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Courts located in Delaware have jurisdiction over any dispute.
This does not take away the protections of the consumer law of the place where you live, and it does not stop you bringing a claim in your local small-claims court where that is available to you.
18. General
If a court finds part of these terms unenforceable, the rest stays in force.
If we do not enforce a right straight away, we have not given it up.
These terms, together with the Privacy Policy and the subscription terms of your app store, are the whole agreement between us about EyeZenith.
You may not transfer these terms to anyone else. We may transfer them to a company that takes over our business, if your rights under them are not reduced.
